General Terms and Conditions of Sale



PREAMBLE

These terms and conditions of sale supplement the previous description and set out the conditions of activities relating to the organization and sale of excursions or stays on the website www.mygrapeexperience.com.

The customer can consult these terms and conditions directly on the website (or on behalf of the person making the reservation for another person or on behalf of a group; they acknowledge this and agree to provide each traveler with the general terms and conditions of sale as well as all information provided by Grape Experience) before making any commitment. These terms and conditions supplement the preliminary information referred to in Article R.211-4 of the French Tourism Code, in addition to the service descriptions and, in some cases, the specific payment and cancellation conditions applicable to certain services. In the latter case, the specific conditions indicated in the product description will prevail over the general text of these Special Terms and Conditions of Sale.

The prior information provided for in Article R. 211-4 of the Tourism Code may be modified after publication and consultation by travellers, in particular with regard to the main characteristics of travel services, the price, the payment methods, the minimum number of people possibly required for the performance of the excursion, the conditions of cancellation by the customer, in accordance with Articles R. 211-5 and L. 211-9.

By confirming their contract, the traveler acknowledges having read these Terms and Conditions as well as the more specific descriptions of the chosen services. Failure to accept all or part of these Terms and Conditions will result in the traveler waiving any right to use or benefit from the services provided by Grape Experience.

These Special Terms and Conditions of Sale are up to date as soon as they are published on the website www.mygrapeexperience.com and cancel and replace any previous version.
Grape Experience offers full-day and half-day excursions, multi-day excursions, transfers, and visits to champagne houses with tasting.

No right of withdrawal and telephone solicitation


Pursuant to Article L.221-28-12° of the Consumer Code, the right of withdrawal provided for in matters of distance selling is not applicable to contracts for the sale of accommodation, transport, catering and leisure services which must be provided on a specific date or at specific intervals.

When their telephone contact details are collected, the traveler is informed that they have the option to register on a free list to opt out of telemarketing calls, for example:http://www.bloctel.gouv.fr/


Booking details


The traveler is presumed to have the legal capacity to place an order on the website, to be at least 18 years old or emancipated, and not to be under guardianship or conservatorship. They are solely and entirely responsible for providing all the information necessary to submit the booking request and declare that this information is truthful, accurate, and up-to-date.


To book an excursion or a stay:

– The traveler should review the information located in the product sheet for each activity and excursion on the "Private Experience" page.

– The traveler then clicks to choose their desired activity or activities.

– The traveler must complete the form at the bottom of the "Private Experience" page with all the requested information in order to send a booking request.

– The traveler will receive a response from Grape Experience within a maximum of 24 hours with a priced excursion proposal expressed in inclusive price and in euros.

– The traveler reviews the proposal summary, accepts the Special Terms and Conditions of Sale, and must give their agreement by email to reservation@mygrapeexperience.com. An option will then be registered on the date(s) of the excursion.

– The traveler completes the missing information during their first request as well as the contact details of the other travelers accompanying them if necessary by email.

– The traveler will have to pay the total amount of the proposal sent in order to validate the option recorded via a payment link.
Otherwise, the option will be automatically removed 7 days after it was activated. For bookings made less than 15 days before the requested date, no option can be registered and full payment for the service will be required to reserve the excursion.

– The traveler receives an email confirming receipt of their reservation with a summary containing the essential characteristics of the service purchased and constituting the travel contract.


Without this email, the reservation will not be considered valid. In accordance with Article 1369-5 of the French Civil Code, the reservation and reservation confirmation are deemed received when the parties to whom they are addressed are able to access them. In the event of incorrect contact information provided by the Client, Grape Experience cannot be held responsible for the email not being received or not being received.

– Upon their return, the traveler will receive an email encouraging them to share their travel experience.

The excursion booking is effective and confirmed upon receipt of payment by Grape Experience.
The balance must be paid no later than 30 days before the departure date.
Grape Experience reserves the right to refuse a traveler if the full price of the stay has not been paid 30 days prior to departure. In this case, the contract is considered cancelled by the client.

Payments can be made by bank transfer, credit card (excluding American Express) via a payment link.

Confirmation of the travel contract implies the client's acceptance and acknowledgment of these specific terms and conditions. The client expressly acknowledges having reviewed, in paper or electronic documents, the preliminary information and descriptions relating to the activities they have chosen. These specific terms and conditions, as well as the technical and practical information for each activity, are freely available on the website www.mygrapeexperience.com.

Price


The prices shown in the offers sent by email are inclusive of all taxes, in Euros and may be updated according to changes in the activities offered.

The final price of your trip will be confirmed at the time of booking, depending on the activities chosen.

The description of each excursion specifies the services included and not included. Restaurants are not included in the excursion price and will be charged separately to the client, unless explicitly stated in the booking confirmation.

Prices never include: restaurant, tips, personal expenses, surcharge for changing the number of participants and generally anything not mentioned in the contract.

Responsibility


Grape Experience is fully responsible for the proper execution of the obligations arising from the travel contract as defined in Article L. 211-16-I of the French Tourism Code. The traveler is informed that Grape Experience cannot be held liable under any circumstances when the damage is attributable either to the traveler or to a third party.

– to the provision of travel services and is of an unforeseeable or unavoidable nature, or to exceptional and unavoidable circumstances (war, attack, riot, revolution, nuclear disaster, climatic or geological events).

In the event of the application of the strict liability of Grape Experience for the actions of its service providers within the meaning of the aforementioned article, the limits of compensation provided for in Article L. 211-17-IV of the Tourism Code.
Grape Experience cannot be held responsible for any loss, forgetting, theft or damage to personal belongings during the services it organizes on behalf of its clients.


Modification


Any modification to a reservation, once it has already been validated, made by the buyer, will be subject to a modification fee of €20.


Cancellation by the traveler

In accordance with Article L. 211-14, the traveler may terminate (cancel) their contract at any time or modify it (any modification less than 14 days before departure is considered a cancellation), by email. The date of receipt of the email will be considered proof.

Unless otherwise specified in the quote and contract, the amount of sums withheld from the reimbursement is calculated according to the scale below:

– Up to 30 days before departure: 5% of the price of services including VAT.

– From 30 to 7 days before departure: 35% of the price of services including VAT.

– Less than 7 days before departure: 100% of the price of services including VAT.


Any trip interrupted or shortened by a participant for any reason whatsoever, except for medical reasons, will not give rise to any refund.

Cancellation by Grape Experience


If Grape Experience has to cancel a departure for any reason, those already registered will be fully refunded, or offered an alternative solution which they are not obliged to accept.

Grape Experience may cancel the trip without compensation if the minimum number of participants is not reached. Activities are suspended, and Grape Experience will inform the client accordingly.

– 7 days before the trip, which lasts from 2 to 6 days

– 48 hours for trips not exceeding 2 days.


If no alternative date or destination is offered, there will be no obligation to contract.

– In the event of exceptional and unavoidable circumstances preventing the execution of the contract.

In this case, or if a significant part of the services cannot be provided, or when a non-conformity significantly disrupts the trip, and if it proves possible for Grape Experience, services of equal or superior quality will be offered at no extra cost.

In certain circumstances, particularly due to weather conditions, the program, transportation, and activities may be modified. The traveler may not refuse the modification without a valid reason, especially if the services offered are not comparable.

Each time, we do our best to ensure you can complete your program by offering alternatives: another location, another route, another activity, another date…


Flights and transportation


Transportation between activities is included in the price of the service (including VAT). Transfers outside the designated pick-up and drop-off locations can be arranged for an additional fee and with prior notice.


ForwardingFor train or plane tickets connecting to your transfer, we advise you to allow sufficient time for your connection. If you miss your international flight and your trip due to a connection delay, Grape Experience cannot be held responsible. Therefore, we advise against booking discounted, non-refundable, and non-changeable tickets. In the event of a delay, Grape Experience cannot cover any costs associated with the non-refundability of these tickets, nor can they justify any cancellation by the client or any refund for unused services.


Transfer: In the event of a change in arrival or departure times not initially planned on a flight or train with an organized transfer, a fee may be charged to the customer to compensate for the additional time spent.


Remarks


– Each participant is aware of and responsible for their alcohol consumption during Grape Experience excursions. Grape Experience cannot be held liable for any accident or damage caused by a client to a Grape Experience employee or any other service provider.

This also applies to beneficiaries and all family members.
We make sure to provide water bottles to ensure hydration throughout the day.

– Any shortened trip, any service not used by the traveler cannot give rise to any refund.

– Grape Experience reserves the right, unless otherwise stated in writing by the traveler at the time of booking, to use photos or videos taken during the trip to illustrate certain programs, without this giving rise to compensation or reimbursement.


Assignment of contract

The traveler may transfer their contract to a third party and must imperatively inform Grape Experience by any means allowing for acknowledgment of receipt as soon as possible and at the latest 7 days before the start date of the trip, indicating precisely the name and address of the transferee and the participant in the trip, justifying that the latter meets the same conditions as them to carry out the stay or trip.

The transferor or the transferee shall be jointly and severally liable for the payment of any outstanding balance of the price as well as any appropriate costs incurred by this transfer.


  1. Claims, disputes

The traveler must report any complaint or dispute by email. Failure to do so may result in their compensation claim being rejected.

Any complaint or dispute concerning the smooth running of the trip must be reported and substantiated within one month of the return date, by email to reservation@mygrapeexperience.com. Supporting documents or a written statement from the local service provider must be included with the request. Grape Experience will process the case as quickly as possible, taking the time to conduct an investigation with the service providers.


Mediation

After contacting Grape Experience's customer service and failing to receive a satisfactory response or no response within 60 days, the customer may contact the Tourism and Travel Mediator: Tourism and Travel Mediator – MTV – BP 80 303 - 75 823 Paris Cedex 17, as well as via their website:www.mtv.travel.


  1. Protection of personal data

It is noted that the personal data requested from the Customer is necessary for processing their order and issuing invoices, among other things.

This data may be communicated to the Company's potential partners responsible for the execution, processing, management and payment of reservations.

The information collected by Grape Experience is processed electronically to best respond to requests. This personal data is processed in accordance with the GDPR – General Data Protection Regulation of April 27, 2016, which came into effect on May 25, 2018. This data is intended for Grape Experience and its partners and may be transferred to third parties for the purposes of executing, processing, managing, and processing payments for reservations.

Each traveler has the permanent and free right to access, rectify, delete, or object to their personal data at any time. Simply contact Grape Experience (providing your full name, address, and email) with proof of identity, either by mail or email to reservation@mygrapeexperience.com.
